Conditions


1. Business Relationship

The following general terms and conditions regulate the contractual relationship between the customer and physiotherapy practice Patrick Tfinkji. Customer is the person who uses applications for himself or for third parties from the time of booking. Customer is also the purchaser of vouchers. By booking these services, the customer accepts the general terms and conditions. Deviating general terms and conditions of the customer are not valid. The physiotherapy practice reserves the right to change the general terms and conditions.
Before using our services, the private patient must sign a treatment fee contract with reference to our general terms and conditions. The general terms and conditions will be presented to the customer upon request.


2. Payment

The customer / patient undertakes to transfer the amount agreed in the treatment fee contract after invoicing without deduction to the bank named in the invoice.


3. Missed appointment

The customer / patient has to pay the cancellation of a missed treatment appointment to the service provider at the respective health insurance rate of the treatment costs incurred. He will receive a separate invoice for this.


4. Appointment Cancellation

Agreed appointments are to be kept. If an appointment cannot be kept for an important reason, the practice must be informed of this personally at least 24 hours before the agreed appointment by telephone, stating the customer/patient name, treatment date and time. The customer / patient is responsible for adhering to these deadlines. Otherwise, the practice can charge the customer / patient for the missed appointment in the amount of the health insurance rate / private rate.


5. Delays

If you are late, your treatment time will be reduced accordingly. Delays of more than 15 minutes are considered a missed appointment and will be billed privately.


6. Co-Payments

Necessary co-payments are to be paid before the start of treatment in the practice. Unless stated in the prescription, patients who are exempt from co-payments must submit proof of their exemption.

7. Right of withdrawal customer / patient

If the customer / patient is not satisfied with the services provided by the physiotherapy practice Patrick Tfinkji, he can withdraw from the treatment fee contract. The services already rendered must be paid in full. Points 3 and 4 also apply in this context. The withdrawal from the treatment fee contract is to be addressed exclusively in writing to the physiotherapy practice Patrick Tfinkji and must be received by the physiotherapy practice Patrick Tfinkji no later than 48 hours before the next appointment. A cash payment or reversal of the amount of money for vouchers is not possible.


8. Right of Withdrawal Practice

The physiotherapy practice Patrick Tfinkji is entitled to withdraw from the contract if the customer / patient behaves contrary to the present terms and conditions. Services that have already been rendered are to be paid immediately after receipt of the invoice. Any damage caused by the customer/patient not fulfilling the contract will also be charged.


9. Provision of Services

The service provider undertakes to meet the agreed deadlines with reasonable deviations. The times given are approx. times including rest periods afterwards, as they include organizational and hygienic processes.


10. Claim for Damages

The customer / patient is not entitled to any compensation in relation to point 9.


11. Changes

The physiotherapy practice Patrick Tfinkji reserves the right to change or cancel agreed appointments for important reasons. The physiotherapy practice Patrick Tfinkji also reserves the right to change prices.


12. Default of Payment

If the invoice amount is not posted to the account of Physiotherapy Practice Patrick Tfinkji within the specified payment period, Physiotherapy Practice Patrick Tfinkji is entitled to charge default interest of 5% above the applicable base rate (§ 288 BGB).


13. Disclaimer

The physiotherapy practice Patrick Tfinkji is not liable for damage to the private property of contractual partners. Unless the damage was caused intentionally or willfully. Liability for theft or similar is also excluded. Physiotherapy practice Patrick Tfinkji also excludes any liability for damage to the customer / patient that arises from non-compliance with the terms and conditions or from misconduct / negligence on the part of the customer / patient.


14. Venue

The place of execution of the contract is always the practice headquarters or the place of the home visit.


15. Additional Costs

Additional costs apply if the customer / patient requests a home visit. The costs depend on the distance and the contractual agreement.


16. Terms of Contract

In principle, the agreements concluded between the physiotherapy practice Patrick Tfinkji and the contractual partner apply. A contract change can only be made in writing and must be signed by both contracting parties.


17. Severability Clause

Should a clause of these contractual conditions be ineffective, this does not affect the validity of the other clauses. If a clause of these conditions is only partly ineffective, the other part remains valid. The contracting parties are obliged to replace an ineffective clause with an effective provision that comes as close as possible to the economic purpose of the ineffective contractual condition. If the terms and conditions are not contradicted within 14 days, they are valid according to German law.


18. Final Provision

Statements made by the owner or employees of the physiotherapy practice Patrick Tfinkji are always based on the current state of knowledge. Since there are different teaching opinions on some topics, we cannot guarantee in every respect that we have made the most up-to-date (or currently recognized as the best) statement (or therapy used).
